Are retirement assets (IRA) protected from lawsuits?

Are retirement assets (IRA) protected from lawsuits? For example, if I am in an auto accident and it is my fault, can the accident victim sue me



and collect from my IRA assets in addition to the



auto insurance coverage?



In other words, do I have to include my IRA assets



in an 'umbrella' policy?

no but 401k plan assets are (still in the companys name)



neither are protected frm divorce settlements.
IRA assets are protected in a bankruptcy proceeding. So if you're sued over the accident and declare bankruptcy, your IRA assets should be protected. But if you're not in bankruptcy, IRA assets could be subject to garnishment or other collection actions. You'd have to consult with a lawyer in the state where you live for a firm answer.



IRAs have nothing to do with umbrella policies. Umbrella policies insure you against legal liabilities. They'd don't insure IRAs.
IRA accounts are only protected from income taxes in a small way. That's all.
