A few days ago, i got into an car accident. The situation was that I entered an intersection to make a left turn. The light was green. I waited in the intersection to make the left turn, yielding to oncoming traffic. While waiting the light went from yellow then to red. After the light turned red i went ahead with the left turn to get out of the intersection.An oncoming car ran the light and hit me. When the police came, NO citation was issued to either party. Reason being the other parties unclear description to what happened. As far as i was concerned we were both going to take care of our own cars. The other parties insurance company then called me a few days later informing me they were making a claim against me and the accident was my fault because i " failed to yield". I was then instructed by my insurance agent to file a claim to protect myself. The problem with this whole thing is there was no witnesses on the light colors during the accident. I was told in that case the insurance companies go off of statistics. Which in that case most of the time the person making the left turn is at fault. I want to know if there is anything i can do? This is my first accident and i would really appreciate some advice.

Tell your insurance claims adjuster your version of the facts. Depending on which lane the point of impact happened, you may have less fault than the other driver. Just because the other driver had a green light, they have the duty not to enter into an intersection until the intersection has been cleared and it is safe to enter the intersection. ALWAYS try to get a witnesses information when ever you get in an accident if you have any. Otherwise it is word against word, BUT you will most likely have a portion of the blame for the person turning left usually does own most of the blame.
